NoHo Photo Studio – Terms of Service

Welcome to NoHo Photo Studio! These Terms of Service outline the rights and responsibilities of both the client and the photographer. By booking a session or renting a space, you agree to the following terms. For Only Photo studio rentals please check "Rules & Rental agreement"

Booking & Payment

A non-refundable deposit of $50 - $150 (depending on a service/your package and contract) is required to secure your booking. The remaining balance is due on the day of the session.
Sessions are booked on a first-come, first-served basis. Your session is not confirmed until the deposit is received.

Cancellations & Rescheduling

Clients may reschedule their session at least 48 hours or 2 weeks in advance without penalty (depending on your photography service and your individual contract).
Cancellations made less than 48 hours (2 weeks) before the session will incur a 50% cancellation fee of the session price or lost of the deposit.
No-shows or same-day cancellations are non-refundable.

Session Conduct & Cooperation

Clients must arrive on time for their scheduled session. Sessions that start late due to client delays may result in reduced shooting time.
The photographer/studio manager reserves the right to refuse service if a client is disruptive, intoxicated, or fails to comply with studio guidelines.

Image Delivery & Editing

Edited images will be delivered within 1-14 business days (depending on your contrcat and service) via an online gallery or other agreed-upon method.
Minor retouching (skin smoothing, color correction, etc.) is included based on your chosen package in original photographer's style, with one round of revisions (during 48 hours of the retouched photos delivery) per selected image. Amount of retouched images will depend on your chosen package.
Raw or unedited images are not provided under any circumstances. It may be changed upon your contract conditions.

Copyright & Usage Rights (photography services)

NoHo Photo Studio (and photographer who took your photos depending on a contract, e.g. Alexandra Hryshyn) retains the copyright to all images. Clients receive a personal or commercial use license depending on the service booked and depending on your contract.
Clients may use the images for personal branding, social media, websites, and promotional materials. However, resale or third-party licensing requires written permission.
NoHo Photo Studio reserves the right to use images for portfolio, website, and marketing purposes unless otherwise agreed upon in writing.

Digital & Print Orders

Digital images are non-refundable once delivered. Please ensure you review and approve selections before final edits.
If a print order arrives damaged, a replacement will be issued at no additional cost. We carefully examine all printed products by our team to guarantee that you receive high quality products.

Liability & Force Majeure

NoHo Photo Studio is not responsible for lost or damaged images due to unforeseen circumstances such as equipment failure, accidents, or natural disasters.
If an emergency prevents the photographer from completing the session, a reshoot or refund will be arranged.

Agreement & Acknowledgment

By booking a session, clients confirm that they have read and agree to these Terms of Service.

SMS Terms of use

[NoHo Photo Studio] TEXT MESSAGING TERMS OF USE

By "Opting In" to or using a “Text Message Service” (as defined below) from [NoHo photo studio and Alexandra Pro Photos], you accept these Terms & Conditions. [IF APPLICABLE: THIS AGREEMENT IS SUBJECT TO BINDING ARBITRATION AND A WAIVER OF CLASS ACTION RIGHTS AS DETAILED BELOW.]

This agreement is between you and [NoHo photo studio] or one of its affiliates. All references to "[Noho photo studio]," "we," "our," or "us" refer to [Noho photo studio], [7421 Laurel canyon blvd, unit 13, north Hollywood 91605].

DEFINITIONS

"Opting In," "Opt In," and "Opt-In" refer to requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, responding to, or otherwise consenting to receive one or more text messages.

"Text Message Service" includes any arrangement or situation in which we send one or more messages addressed to your mobile phone number, including text messages (such as SMS, MMS, or successor protocols or technologies).

CONSENTING TO TEXT MESSAGING

E-SIGN DISCLOSURE

By agreeing to receive text messages, you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by replying STOP.

[NoHo Photo studio] TEXT MESSAGE SERVICE PRIVACY POLICY

We respect your privacy. We only use information you provide through this service to transmit your mobile messages and respond to you. This includes, but isn't limited to, sharing information with platform providers, phone companies, and other vendors who assist us in the delivery of mobile messages. Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Nonetheless, we reserve the right always to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property. This Text Message Service Privacy Policy applies to your use of the Text Message Service and isn't intended to modify our general [“Privacy Policy” OR RELEVANT NAME OF PRIVACY POLICY REFERENCED IN SECTION ABOVE], incorporated by reference above, which may govern the relationship between you and us in other contexts.

COSTS OF TEXT MESSAGES

We do not charge you for the messages you send and receive via this text message service. But message and data rates may apply, so depending on your plan with your wireless or other applicable provider, you may be charged by your carrier or other applicable provider.

FREQUENCY OF TEXT MESSAGES

This Text Messaging Service is for conversational person-to-person communication between you and our employees. We may send you an initial message providing details about the service. After that, the number of text messages you receive will vary depending on how you use our services and whether you take steps to generate more text messages from us (such as by sending a HELP request).

OPTING OUT OF TEXT MESSAGES

If you no longer want to receive text messages, you may reply to any text message with STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE. As a person-to-person communication service, opt-out requests are specific to each conversation between you and one of our employees and their associated phone number. After unsubscribing, we may send you confirmation of your opt-out via text message.
